New rules for nicotine-containing e-cigarettes and refill containers

New rules for nicotine-containing e-cigarettes have entered into force. Generally, the new legislation makes it legal to sell nicotine-containing e-cigarettes and refill containers in Denmark, provided that the products have been notified to the Danish Safety Technology Authority.

The new rules came into force on 7 June 2016. If you are selling nicotine-containing e-cigarettes and refill containers that comply with the new legal requirements, you must submit a notification for the products to the Danish Safety Technology Authority no later than 20 November 2016.

E-cigarettes regulated as medicines

E-cigarettes and refill containers – with and without nicotine – will be considered as medicinal products if the marketing of the products give the impression that they can be used for preventing or treating diseases, such as nicotine dependence and abstinences. In that case, the products will be regulated by the Danish Medicines Agency. Medicinal products must be authorised by the Danish Medicines Agency or the European Commission before they can be placed on the market in Denmark. Currently, no authorisation has been granted to e-cigarettes or refill containers in Denmark.
